i think it has something to do with all the movies from the '80's 90's where stallone makes passionate love every time.

Perhaps you meant love scene.
A sex scene is a broad term.
A love scene is more specific.
A rape scene is more specific.
Both consist of sex, therefore both constitute a sex scene.
Maybe it's just a matter of cultural semantics.

At the risk of turning this into a semantics debate rather than a film one... rape and sex is like prod and stab... they describe a very similar physical act, but have entirely different meanings.
